Staying positive


I am naturally quite a competitive soul, but people don't always realise it as I also work very hard at enjoying my sailing. Sometimes that means accepting you're not going to do very well before an event, and other times it means accepting that things go wrong on some occasions when a result slips away from you.
I had plenty of tests on my 'smile and laugh through it' this summer, most recently at Federation Week. Work commitments meant we could only do the final three days, so no discards for us. In the final race, which we had to win, we were leading by a country mile, but sailed past the correct mark and gave ourselves an extra, impossibly long beat, to catch the fleet. I took solace in our performance - we sailed very well and I could take satisfaction from, winning the start, going fast and getting the tactics right. The silverware might not have been ours, but I'd prefer the satisfaction of sailing well and losing to a silly mistake, than sailing badly and winning.
Sailing in an RS200 at the RS Games with Ian Jubb [aka Jubby] was another matter. We were definitely too heavy for the boat (Jubby's two-year-old son might have been a better option!). Jubby had therefore decided that the 200 would provide a nice holiday for him at the conclusion of his nine-nationals challenge.
I thought I could handle this idea no problem - after all I am 'miss positive'! Day one was okay, despite

banging every corner in an effort to minimise tacks and gybes, a starting tactic that had one aim: to be first out of the gate, and a no-hiking policy, I quite enjoyed the novelty of cruising round the course. But day two taught me that I'm nowhere near as good at 'crusing round' as I'd like to be... we had a laugh - you can't do anything other with Jubby - but I spent the whole day wishing that we were in an RS400. Hats off to Jubby for his achievement, and for keeping a cheery face throughout! See page 48.
Talking of achievements, it was a great coup for sailing to be the first sport to name some of its Olympic team (see page 6 and page 24). Congratulations to all 11 athletes named, although one must spare a thought for the 'oh so nearlys'. How gutting to be Penny Clark, Giles Scott or Nick Thompson...
Still, just as there can only be one winner, there can only be one Olympic representative in each class, and sad

as I was to see Penny miss out in the 470, I was delighted for Hannah Mills and Saskia Clark - so too was Snoop Dogg who gave Hannah his own shout of support - another nice little lift for sailing, maybe we could persuade him to be one of the round-the-island race celebrities next year!

Why is it such a good thing? Sailing suffers more than many sports from its reputation as an activity for the elite. But for every rich owner, there are 10-20 crew, and then there are those sailing Mirror dinghies, like the one Hannah Mills first tried sailing in. Spain to increase VAT rate

According to IBINews "Spanish trade body ANEN has expressed deep concern over government plans to increase the standard value added tax tariff to 18 per cent from the current 16 per cent. The measure, announced last September, will take effect on July 1, 2010."

Last week, an increase took effect for VAT rates in Greece that is expected to affect yacht charter vacations.

Following unsuccessful tentative by brokerage companies to build (and sell) superyacht in China, China Communications and Transportation Association (CCTA) President Qian Yongchang said that "now is the time for China to develop the yachting industry, even though at the beginning, the high-end recreational boats may be accessible only to high earners."

However, industrial insiders said that during the beginning stage, it is unrealistic to expect the Chinese to purchase yachts with the same passion as they pursue cars or houses.

Good news: Sunseeker 38m sold !
The Sunseeker 38 Metre Special Edition superyacht was purchased by a buyer from the GCC on the very first day of this year’s Dubai International Boat Show for Dh72 million ($19.6 million).
Bad news: John Braithwaite has resigned as a director from the board of Sunseeker International Ltd.The chief of design and development at the UK boatbuilder, and brother of former. According to IBInews, "Both Robert and John Braithwaite left the board of the parent company Sunseeker Holdings Ltd on December 23, 2009. A week prior to their departure John Darlingon, head of corporate restructuring KPMG, was appointed as the new chairman of the Sunseeker Holdings board."

Yacht Broker Advice...

Will Purchasing an LLC Avoid Sales Tax on a Yacht?
I am considering the purchase of a fairly expensive yacht that happens to be owned by a Delaware LLC.
My yacht broker has advised that I can avoid paying sales tax on the purchase if I buy the LLC itself rather than the yacht. He also indicated that this could be done without spending the time outside of California that would otherwise be required to avoid sales tax.
Is this true?
If so, what are the issues that I should look out for when purchasing an LLC?

Microburst blamed for sinking of tall ship Concordia, all 64 rescued

Sail The World.com - 48 students and the 16 professional crew and teachers from the Concordia, which sank 300 miles off the coast of Brazil, have been rescued successfully. The story of their rescue could be worthy of a scene in a novel, but it's also a good example of well-trained sailors.

"Super Yacht Auction, the new auction platform for super yachts (> 24 metres), presents its first global auction: a new Schooner of 100 ft (32,80 metres).
The auction, held at www.superyachtauction.com will be open for bids until 1 March next, 14:00 h. (UTC+1).  The owner of the ship has chosen Super Yacht Auction in order to conclude a fast sale."
Fractional ownership, fix brokerage fee, optimized yacht management program and now super yacht auction...2010 will be a challenging year for super yacht service companies.

2009: Boat repo firm breaking sales records

April 200 - FORT LAUDERDALE, Fla. – For boat repo and auction firm National Liquidators, 2008 was a record breaking year. Sales were up 86 percent, compared to 2007, to nearly $82 million and orders were taken to repossess 3,066 boats, the highest number of vessels in its 21 years of business, according to an article yesterday in the Sun Sentinel.

So far, 2009 looks even better. The company is repossessing about 380 boats a month, and the company’s president, Robert Toney, told the newspaper that number may increase to more than 400.

In addition, the average size of the vessels continues to climb. While Toney told the newspaper that most boats the company seizes range from 30 to 50 feet in length, an increasing number of repossession orders for 55- to 75-foot boats and larger have been taken.

The company was in the news earlier this week for repossessing jailed financier Bernard Madoff's 55-foot, $2.2-million, custom-built fishing boat for federal authorities.

National Liquidator’s subsidiary, National Maritime Services, impounded the boat, which is expected to be sold at auction to help repay investors Madoff defrauded, the newspaper reported.

Superyacht Charter Market: an American point of view

Obviously, the superyacht market is rather slow now.
The owners a well as the big brokerage companies are hit hard by the economic crisis but what about the charter market ?

Here is a copy of an interesting post published on Power & Motoryacht Forum:

"Hi everyone - I'm new to this wonderful Forum site, so please forgive me if I make some mistakes as to etiquette, etc.

As to the financial crises, I can share my perspective from the charter side of the yacht industry. Our US-based company, SailAway, deals primarily in megayacht rentals. [ http://www.1800sailaway.com ]

We have seen a dramatic drop in both inquires and charters. Most disturbing for us is the fact that 45% of our summer rentals come from Russian clients. In summer, 2008, this percentage dropped to 10%.

Our winter holiday business (Christmas and New Years periods) is off 70%.

You would be amazed how much "inventory" is still available for late December charters in the CAR. We are now getting calls from yacht managers at CNI, Fraser, etc, begging us for work. Sure wish we could oblige, but the calls for charters are just not there.

The interesting by-product of this situation is the availability of "deals" not normally associated with charters. In most years, the charter yacht owners set strong premiums such as 14 night minimum rentals with 10% surcharges at year end. This year, over 70% of the available charter yachts are willing to accept 7-night rentals.

The few potential customers that have called now see an opportunity to work a deal for a rental. One repeat customer asked us last week to submit an offer that was $55,000 lower than the yacht's published rate (220k down to 165k). The yacht manager said the owner will accept the offer AND throw in an extra night free of charge! Such as deal was practicaly unheard of just one year ago.

It's hard to predict a bottom to this financial mess, but no matter our business or jobs, we are globally all in this together. Let's hope we continue to look out for one another and help those in our families and circle of friends who might be struggling, especially with the holiday season upon us.
